1. Acceptance

ANY PARTICIPATION IN OUR SERVICES WILL CONSTITUTE AGREEMENT OF THE TERMS DESCRIBED HEREIN. PLEASE READ THE TERMS OF SERVICE CAREFULLY AND IN THEIR ENTIRETY. IF YOU OBJECT TO ANYTHING OUTLINED HEREIN PLEASE DON'T USE OUR SERVICES.

2. Required Age and Residence

Participation in our Services requires that you are at least 18 years of age and are a resident in the United States. Additionally your participation in our Services must not conflict with any local or state laws governing internet usage and/or the selling/purchasing of items online.

3. Prohibited Items

In effort to protect our members you are prohibited from listing any items that: are related to a recall, in poor condition, are illegal for sale in certain geographic regions, are homemade (not mass produced), are missing safety components, no longer function as designed/intended, have lead-based paint, have developed a reputation as being unsafe, or are not age appropriate.

4. Conduct

When using our Services YOU ARE STRICTLY PROHIBITED FROM ENGAGING IN ANY OF THE FOLLOWING:
- Posting or transmitting anything that is unlawful.
- Engaging in any activity that is unlawful.
- Posting irrelevant Content.
- Selling multiple, unrelated items, in a single listing.
- Providing information that is misleading, incomplete, or inaccurate.
- Using threatening, demeaning, degrading, racist, or sexist language.
- Posting Content that is libelous, defamatory, obscene, pornographic, abusive, or threatening.
- Harassing or stalking other members.
- Bulk messaging members.
- Impersonating other members and/or companies and/or organizations.
- Using material that is copyright or trademark protected and representing it as your own.
- Soliciting other members for anything other than a listing of interest.
- Marketing products or services to other members.
- Engaging in "bait and switch" tactics.
- Linking to third party websites.
- Attempting to inject client-side code (JavaScript) or upload infected images.
- Using bots or software to automate activity with our Services.
- Attempting to gain unauthorized access to any portion of our Services.
- Spoofing communications to/from our Services.
- Decompiling or reverse engineering components of our Services.

5. User Content

You grant us a license to use all Content you post to and through our Services. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other Content to the site, you are granting us a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat. You will not be compensated for any Content you post to and through our Services. By posting Content to and through our Services you warrant and represent that you own the rights to the Content or are otherwise authorized to post, distribute, display, perform, transmit, or otherwise distribute the Content.

7. Payment Policy

All purchased listings are non-returnable, non-refundable, and non-transferable. In the event an item is sold before the listing period ends users are encouraged to repurpose the listing to sell another item.

8. No Warranties

WE HEREBY DISCLAIMS ALL WARRANTIES. WE ARE MAKING OUR SERVICES AVAILABLE "AS IS" WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, OUR SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING OUR SERVICES, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitations of Liability

OUR LIABILITY TO YOU IS LIMITED. TO THE MAXIMUM EXTENT PERMITTED BY GOVERNING LAW, IN NO EVENT SHALL WE BE LIABLE FOR PERSONAL OR PROPERTY DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, LOST DATA, OR LOST PROFITS, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES OR ANY OTHER MATERIALS OR SERVICES PROVIDED TO YOU BY US OR ITEMS PURCHASED OFF THE SITE. This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action.

10. Indemnity

You agree to indemnify and hold us and our officers, directors, employees, consultants, agents, and representatives harmless from any and all claims or demands, including reasonable attorney fees and court costs, made by any third party due to or arising out of Content you submit, post or make available through our Services, your use of our Services, any product or service you sell through our Services, your violation of the TOS, your breach of any of the representations and warranties herein, your personal conduct or your violation of any rights of another. The obligations under this clause will survive termination of these TOS.

11. Intellectual Property Compliance

When posting Content to and through our Services you agree to abide by all laws governing intellectual property. You assume sole responsibility for any Content you post that infringes on the rights of a third party. The burden of proving the Content you post doesn't violate the rights of a third party rests solely on you.

12. Affiliate Relationships

We have no control over, and no liability for any third party websites or materials. A number of our affiliate relationships are linked to from within our Services. Since we have no control over their content we make no guarantees about their information, claims, content, or accuracy.

13. Termination of Service

We reserve the right to limit, suspend, or terminate Services in the event you fail to comply with the TOS. This may include the removal of some listings, all listings, and/or suspension of your account without refund. In addition to termination of service illegal activity may subject you to civil and/or criminal liability.

14. Notification of Claims of Infringement

We recognize and respond to any allegations that our Services are displaying material that is either copyright or trademark protected. 16. No License

No grants or permissions are made to you to use any of the trademarks, service marks, images, or logos owned by us.

17. Governing Law/Jurisdiction

These TOS shall be construed in accordance with and governed by the laws of the United States and the State of New Jersey, without regard to any conflict of laws provisions. Any dispute arising under these TOS shall be resolved exclusively in the state and federal courts of the State of New Jersey, to which exclusive jurisdiction you hereby irrevocably consent to submit.

18. Notice of Change

We reserve the right to change this Policy at any time. We will convey the change of this Policy via email and/or through website notifications. All changes to the Policy become effective as soon as they are posted. Continued usage of our Services after TOS changes serves as acknowledgement that the new Policy has been read and is accepted by the user.
